§ 1. General provisions
- These Terms and Conditions set out the rules for using the online shop available at shop.skybiotic.com (hereinafter: the “Shop”), including the rules for placing Orders, concluding and performing Agreements, withdrawing from Agreements, filing complaints and providing electronic services.
- The Shop is run by Skybiotic spółka z ograniczoną odpowiedzialnością (a limited liability company) with its registered office in Bielsko-Biała, ul. Zacisze 5, 43-300 Bielsko-Biała, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Biała, 8th Commercial Division of the National Court Register, under KRS number 0001107302, Tax ID (NIP) 5273113697, REGON 528716445, share capital PLN 5,000.00 (hereinafter: the “Seller”).

- These Terms and Conditions are made available free of charge in the Shop in a way that allows them to be obtained, reproduced and recorded, in particular by printing or saving them on a data carrier.
- These Terms and Conditions do not exclude or limit the rights of Consumers and Entrepreneurs with Consumer Rights arising from mandatory provisions of law. In the event of a conflict, those provisions prevail.
§ 2. Definitions
- Customer – a natural person with full legal capacity, a legal person or an organisational unit without legal personality to which the law grants legal capacity, using the Shop.
- Consumer – a natural person performing a legal transaction with the Seller that is not directly related to their business or professional activity.
- Entrepreneur with Consumer Rights – a natural person concluding an Agreement directly related to their business activity, where the content of the Agreement shows that it is not of a professional nature for them, arising in particular from the subject of their business activity as disclosed in the Central Register and Information on Economic Activity (CEIDG).
- Product – a movable item, in particular a cosmetic, presented in the Shop and being the subject of the Agreement.
- Order – the Customer's declaration of intent submitted via the Shop, aimed at concluding an Agreement.
- Agreement – a distance contract for the sale of Products concluded between the Seller and the Customer via the Shop.
- Account – a set of Shop data and functions assigned to the Customer, identified by an email address and password.
- Business Day – a day from Monday to Friday, excluding public holidays.
§ 3. Electronic services and technical requirements
- The Seller provides the following electronic services free of charge: browsing the Shop, the Cart and placing Orders, the contact form and, if available, the Account.
- The agreement for browsing the Shop and using the Cart is concluded for the time these functions are used and terminates when the Customer leaves the Shop or places an Order. The Account agreement is concluded for an indefinite period; the Customer may terminate it at any time without giving a reason by writing to kontakt@skybiotic.com.
- Creating an Account is not required to place an Order.
- To use the Shop you need: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address.
- The Customer may not provide unlawful content or take actions that disrupt the operation of the Shop.
- Complaints about electronic services can be sent to kontakt@skybiotic.com. The Seller handles them within 14 days of receipt.
§ 4. Products and prices
- Product information published in the Shop (description, volume, directions for use, ingredients) constitutes an invitation to conclude an agreement and not an offer within the meaning of the Civil Code.
- Product prices are gross prices in Polish zloty and include VAT. The unit price (per litre or kilogram) is also shown for each Product.
- Prices do not include delivery costs. The delivery cost is shown before the Order is placed, and the amounts are described on the page Delivery and payment.
- Whenever a Product price reduction is announced, the lowest price of that Product in the 30 days before the reduction is also shown.
- Products from the professional line are intended primarily for use in hair salons. All Products should be used in accordance with the description and the instructions on the packaging.
- The photos show the actual Products; the colour of the packaging or product may differ slightly from what is shown due to screen settings.
§ 5. Placing Orders and concluding the Agreement
- Orders can be placed 24 hours a day, 7 days a week.
- To place an Order, you need to: add Products to the Cart; provide delivery details (full name, address, email, phone) and, if the Customer wants a company invoice, also the company name and Tax ID (NIP); choose a delivery method (and a pick-up point, if applicable) and a payment method; accept the Terms and Conditions and click the button confirming the Order with an obligation to pay.
- Before placing the Order, the Customer sees its summary: the Products, their price, the delivery cost and the total amount to be paid. Until the Order is placed, the Customer can correct the data entered.
- After placing the Order, the Customer receives an email confirming its receipt. The Agreement is concluded when the Customer receives the email confirming that the Order has been accepted for fulfilment. For online payments, this email is sent once the payment has been credited.
- The content of the Agreement is recorded and made available to the Customer by sending the Order confirmation to the email address provided and by making the Terms and Conditions available in the Shop.
- In case of doubts about an Order (e.g. an incomplete address), the Seller may contact the Customer by email or phone.
§ 6. Payments and invoices
- The available payment methods are presented in the last step of placing the Order and described on the page Delivery and payment. They include in particular card payment, Apple Pay, Google Pay, BLIK and fast online transfers.
- Online payments are processed by Stripe Payments Europe, Limited, based in Ireland. The Seller does not receive or store payment card details.
- Online payments are made when placing the Order. If the Customer has chosen a traditional bank transfer (if available), the Order should be paid within 7 days of being placed; an Order not paid within this period is cancelled and the Agreement is not concluded.
- The Seller does not offer cash on delivery.
- The Seller issues an invoice for every Order – to the Consumer or, if the Customer provides a Tax ID (NIP), to the company. The Customer agrees to receive invoices electronically at the email address provided. Invoices are issued using the National e-Invoicing System (KSeF) to the extent required by law.
- Payments are refunded (e.g. after withdrawal from the Agreement or acceptance of a complaint) using the same payment method the Customer used, unless the Customer agrees to a different method that involves no costs for them.
§ 7. Delivery
- The Seller delivers Products within Poland.
- Deliveries are available to InPost Paczkomat lockers, to DPD Pickup and DHL POP points and lockers (including in Żabka stores), and by courier to the address provided, carried out by InPost, DPD or DHL at the Seller's choice. The current list of methods, their prices and the free delivery threshold are shown on the page Delivery and payment and in the Cart.
- The Order fulfilment time includes preparing the parcel – up to 2 Business Days from the conclusion of the Agreement – and delivery by the carrier, usually within 1–2 Business Days of dispatch.
- After the parcel has been dispatched, the Customer receives an email with the tracking number and a tracking link.
- We recommend checking the parcel on delivery. If it is damaged, please write up a damage report with the courier or report the damage in the carrier's app and contact the Seller. This is not a condition for exercising rights in respect of non-conformity of the Product with the Agreement.
- For Consumers and Entrepreneurs with Consumer Rights, the risk of accidental loss of or damage to the Product passes to the Customer when the Customer or a person indicated by them other than the carrier takes possession of the Product.
§ 8. Right of withdrawal from the Agreement
- Consumers and Entrepreneurs with Consumer Rights may withdraw from the Agreement within 14 days without giving any reason and without incurring any costs, except for the costs specified in sections 6 and 7.
- The period runs from the day the Customer or a person indicated by them other than the carrier takes possession of the Product and, where the Order covers several Products delivered separately, from taking possession of the last of them. To meet the deadline, it is sufficient to send the statement before it expires.
- The statement of withdrawal can be submitted by email to kontakt@skybiotic.com or in writing to the Seller's address, also using the form published on the page Returns (using the form is not mandatory). The Seller promptly confirms receipt of the statement by email.
- The Seller refunds all payments received, including the cost of delivering the Product (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest standard delivery method offered in the Shop), without undue delay and no later than 14 days from the day of receiving the statement of withdrawal from the Agreement.
- The Seller may withhold the refund until it has received the Product back or the Customer has supplied proof of having sent it back, whichever happens first.
- The Customer returns the Product to: Skybiotic sp. z o.o., ul. Zacisze 5, 43-300 Bielsko-Biała, Poland, without undue delay and no later than 14 days from the day on which they withdrew from the Agreement. The Customer bears the direct cost of returning the Product.
- The Customer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product.
- The right of withdrawal does not apply to Products supplied in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery.
- The statutory right to withdraw from a distance contract does not apply to Customers who are entrepreneurs other than Entrepreneurs with Consumer Rights.
§ 9. Non-conformity of the Product with the Agreement – complaints
- The Seller is liable to the Consumer and the Entrepreneur with Consumer Rights for any lack of conformity of the Product with the Agreement existing at the time of delivery and revealed within 2 years of that time, unless the Product's shelf life is longer – under the rules set out in the Consumer Rights Act.
- If the Product does not conform to the Agreement, the Customer may request its repair or replacement. The Seller may replace the Product when the Customer requests repair, or repair it when the Customer requests replacement, if bringing the Product into conformity in the manner chosen by the Customer is impossible or would require excessive costs. If repair and replacement are impossible or would require excessive costs, the Seller may refuse to bring the Product into conformity with the Agreement.
- The Customer may declare a price reduction or withdrawal from the Agreement when: the Seller has refused to bring the Product into conformity with the Agreement or has failed to do so; the lack of conformity persists even though the Seller has tried to bring the Product into conformity; the lack of conformity is so significant that it justifies a price reduction or withdrawal from the Agreement without first requesting repair or replacement; or it is clear from the Seller's statement or the circumstances that the Seller will not bring the Product into conformity within a reasonable time or without undue inconvenience to the Customer. It is not possible to withdraw from the Agreement if the lack of conformity is minor.
- A complaint can be filed by email to kontakt@skybiotic.com or in writing to the Seller's address. Please provide: your full name, contact details, the Order number, a description of the non-conformity and the date it was discovered, your request and – if possible – photos. A model complaint form is available on the page Complaints (using it is not mandatory).
- The Seller responds to a complaint within 14 days of receiving it. If the Seller does not respond to a Consumer's complaint within this period, the complaint is deemed accepted.
- If the Product is needed to handle the complaint or for a replacement, the Seller collects it from the Customer at its own expense (e.g. by sending a return label or reimbursing the shipping cost).
- The price is refunded in connection with a price reduction or withdrawal from the Agreement without undue delay and no later than 14 days from the day of receiving the Customer's statement.
§ 10. Out-of-court complaint and redress procedures
- Consumers can seek help from a municipal or district consumer ombudsman, consumer organisations (e.g. the Consumer Federation) and use mediation or the permanent consumer arbitration court operating at the provincial Trade Inspection inspectorate.
- Information about these options and the addresses of the institutions are available on the websites of the Office of Competition and Consumer Protection (UOKiK): polubowne.uokik.gov.pl and uokik.gov.pl.
- Using out-of-court dispute resolution methods is voluntary and requires the consent of both parties.
§ 11. Personal data
The controller of Customers' personal data is the Seller. The rules for data processing and Customers' rights are described in the Privacy policy, and the rules for the use of cookies in the Cookie policy.
§ 12. Customers who are entrepreneurs
The provisions of this section apply only to Customers who are neither Consumers nor Entrepreneurs with Consumer Rights.
- The risk of accidental loss of or damage to the Product passes to the Customer when the Product is handed over to the carrier.
- The Seller's liability under the statutory warranty (rękojmia) for defects of the Product expires 12 months after the Product is handed over. The Customer loses the warranty rights if they do not inspect the Product in the time and manner customary for goods of that kind and do not notify the Seller of the defect immediately after discovering it.
- The Seller's liability is limited to the price paid for the Product concerned and its delivery costs and does not include lost profits.
- Disputes are resolved by the court competent for the Seller's registered office.
- Terms of wholesale cooperation (salons, distributors) may be agreed in a separate agreement; in the event of any discrepancy, that agreement prevails. Enquiries: Partnership and contact.
§ 13. Final provisions
- Agreements are concluded in Polish. Agreements are governed by Polish law.
- The Seller may amend the Terms and Conditions for important reasons, in particular in the event of changes in the law, payment or delivery methods or the Seller's details. An amendment takes effect on the date indicated by the Seller, no earlier than 7 days after its publication. Orders placed before an amendment are fulfilled under the previous Terms and Conditions. A Customer who has an Account may terminate the Account agreement if they do not accept the changes.
- Disputes with Consumers are resolved by the courts competent under the Code of Civil Procedure.
- These Terms and Conditions are effective from 21 September 2026.
